Terms Of Service Agreement
1. AGREEMENT
These Terms of Use (the “Agreement”) constitute a legally binding agreement between Byuidating.com (“I-dating) and you concerning Your use of I-DATING’s website (the “Website”) and the services available through the Website (the “Services”). By using the Website and Services, You represent and agree that You have read and understood, and agree to be bound by, the Agreement and I-DATING’s Privacy Policy (the “Privacy Policy”), which is incorporated herein by reference and made part of this Agreement. IF YOU DO NOT UNDERSTAND THIS AGREEMENT, OR DO NOT AGREE TO BE BOUND BY IT OR THE PRIVACY POLICY, YOU MUST IMMEDIATELY LEAVE THE WEBSITE AND CEASE USING THE SERVICES.
As used in this Agreement:
“Member” means a registered user of the Website.
2. PRIVACY POLICY
By using the Website (byuidating.com), You consent to the collection and use of certain information about You, as specified in the Privacy Policy. I-DATING encourages users of the Website to frequently check I-DATING’s Privacy Policy for changes.
3. CHANGES TO AGREEMENT AND PRIVACY POLICY AND OTHER DOCUMENTS
Internet and wireless technology and the applicable laws, rules, and regulations change frequently. ACCORDINGLY, I-DATING RESERVES THE RIGHT TO CHANGE THIS AGREEMENT AND ITS PRIVACY POLICY AT ANY TIME UPON NOTICE TO YOU, TO BE GIVEN BY THE POSTING OF A NEW VERSION OR A CHANGE NOTICE ON THE WEBSITE. IT IS YOUR RESPONSIBILITY TO REVIEW THIS AGREEMENT AND THE PRIVACY POLICY PERIODICALLY. IF AT ANY TIME YOU FIND EITHER UNACCEPTABLE, YOU MUST IMMEDIATELY LEAVE THE WEBSITE AND CEASE USING THE SERVICES. Unless I-DATING obtains Your express consent, any revised Privacy Policy will apply only to information collected by I-DATING after such time as the revised Privacy Policy takes effect, and not to information collected under any earlier Privacy Policies.
4. ELIGIBILITY
BY USING THE WEBSITE OR SERVICES, YOU REPRESENT AND WARRANT THAT YOU ARE IN FACT SINGLE (NOT MARRIED), DIVORCED, WIDOWED OR LEGALLY SEPARATED FROM YOUR SPOUSE OR LOVED ONE, YOU ARE AT LEAST 18 YEARS OLD, AND ARE OTHERWISE LEGALLY QUALIFIED TO ENTER INTO AND FORM CONTRACTS UNDER APPLICABLE LAW. This Agreement is void where prohibited.
You also must be attending Brigham Young University or have attended in the past.
5. PUBLIC PROFILES; INFORMATION PROVIDED BY MEMBERS
You will have to create a profile to be part of I-Dating. In doing so you are making this public for all to see.
6. (Important) YOUR INTERACTIONS WITH OTHER MEMBERS; RISK ASSUMPTION
YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL YOUR INERATION WITH ALL OTHER MEMBERS IN THIS SITE! YOU AGREE TO AND AUNDERSTNAND THAT I-DATING HAS NOT AND WILL NOT EVER IN ANY POSSIBLE WAY BE ABLE TO SCREEN ANYONE. I-DATING DO NOT DO ANY OF THE FOLLOWING IN ANY WAY 1. SCREEN ITS MEMBER 2. CHECK PROFILES FOR ACURACEY 3. CHECK INTO MEMBERS BACK GROUNDS AND CRIMINAL HISTORY. IF YOU DECIDE TO MEET ANY MEMBERS OF I-DATING, I-DATING DOES NOT REPRESENT, WARRANT, ENCOURAGE, GUARANTEE THE CONDUT OF ITS MEMBER OR THEIR COMPATIBLITY WITH YOU. IN NO EVENT SHALL I-DATING BE LIABLE FOR INDRECT OR DIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES OR PROBLEMS ARISING FROM MEETING ANY MEMBERS CONDUCT IN MEETING OR CONNECTION IWHT YOU. MEMBERS ARE AWAYRE OF ALL CONSEQUENCE WICH COULD BE BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEACH, LOSS OF PRIVACY, EMOTIONAL ISSUES, OR ANY OTHER PROBLEMS OR DAMAGES FROM DEALLING WITH COMMUNICATING TALKING TO OR MEETING OTHERMEMBERS OR USE OF THIS WEBSITES AND SERVICES OFFERED.
7. MEMBER DISPUTES/DISAGREEMENTS
I-DATING reserves the right, but disclaims any perceived, implied or actual duty, to monitor disputes between Members. I-DATING WILL NOT BE AT FALT FOR ANYTHING OTHER MEMBERS DO.
8. CONSENT TO RECEIVE EMAIL FROM I-DATING
WHEN REGISTERING WITH I-DATING AND BECOMING A MEMER YOU ARE AGREING AND CONSENTING TO RECEIVING EMAILS THAT DEAL WITH UPDATES, DATING TIPS, AFFILIATES, AND NEWSLETTERS AND OTHERS THAT WE LATER DECIDE. If you have any issues with this please send an email to info@byuidating.com.
9. CONSENT TO RECEIVE COMMUNICATIONS FROM MEMBERS
WHEN REGISTERING WITH I-DATING AND BECOMING A MEMER YOU ARE AGREING AND CONSENTING TO RECEIVING communication from other member including emails, chats winks and other forms of communicating.
10. Payment and Fees
Access to the Website and use of the Services is free; however, you may upgrade to a paid service if you would like. You acknowledge and agree that I-DATING reserves the right to charge for access to the Website and use of the Services and to change its fees from time to time in I-DATING’s discretion.
11. THIRD-PARTY WEBSITES
Dating is linked to third party websites, we do not monitor what goes on these websites and by signing up you agree that we are in way responsible for any of the sites that are linking to or from us as. You are also responsible for taking all responsibility for protecting your computer from any harm like virus or Trojan horses malicious code etc.
13. USER CONTENT
If any content you post on your profile. User content is free for all public to see.
14. YOUR RESPONSIBILITY FOR DEFAMATORY COMMENTS
You understand and agree that you could be full held legally responsible for all your action online. You could also be held responsible for damages suffered by other members as a result of your remarks feedback or anything else you may do. Under the Federal Communications Act of 1996, I-DATING cannot be legally held responsible or liable for any kind of damages arising out of any defamatory or otherwise legally actionable remarks information feedback or content posted on the site.
15. OBJECTIONABLE CONTENT
You agree that you will not use the website or services I-dating provides to post transmit display perform or distribute any content information or materials that are defamatory, abusive, violent, harassing, filthy, pornographic, child porn, encourage or threaten physical harm or solicit personal information or use sex or violence in anyone under the age of 18. You agree to not use hate or racial terms. You will not use any drugs.
I-Dating is not responsible to monitor the contents of the website and specifically disclaims any responsibility or libality. I-dating also has the right to discontinue your account anytime we see fit.
16. PROHIBITED USES
You are not allowed to use the website to do the following: 1. Stalk or harass any individual 2. Pretend to be someone you are not. 2. Provide false or misleading information. 3. Collect data about I-Dating users 4. Steal any software or written content from the website 5. Use the website to send unwanted e-mails to its users. Any violations of this section may be subject to civil and or criminal discipline.
17. INTELLECTUAL PROPERTY
Compliance with Law
You agree that you will obey all the laws of the land, if you break any of the laws of the land you will be held personally responsible for it.
18. DISCLAIMERS; LIMITATION OF LIABILITY
(a) NO WARRANTIES.
I-Dating disclaims all warranties. The website and services area “AS IS”. We also are not responsible for any implied warranties. I-DATING NOR ITS LICENSORS OR SUPPLIERS HAS NO LIABILITY WHATSOEVER FOR YOUR USE OF THE WEBSITE OR OTHER SERVICES.
(b) YOUR RESPONSIBILITY FOR LOSS OR DAMAGE; BACKUP OF DATA
You are responsible for all lost or damaged goods including backing up of data.
(c) LIMITATION OF LIABILITY
I-dating to the max the law allows is not liable ore responsible for any damages occurred or injury that could happen from meeting with anyone associated with I-Dating
(d) APPLICATION
THE ABOVE DISCLAIMERS AND LIMITATIONS DO NOT IN ANY WAY LIMIT ANY OTHER DISCLAIMER OF WARRANTIES OR ANY OTHER LIMITATION OF LIABILITY IN ANY OTHER AGREEMENT BETWEEN YOU AND I-DATING.
19. YOUR REPRESENTATIONS AND WARRANTIES
By using I-dating you warrant that your use of the website will be in accordance with this agreement and any other I-dating policies and all laws of the land.
20. INDEMNITY BY YOU
Without limiting any indemnification provision of this Agreement, You agree to defend, indemnify and hold harmless Byuidating.com and employees/owners from and against any and all claims, actions, demands, causes of action and other proceedings including but not limited to legal costs and fees, arising out of or relating to: (i) Your breach of this Agreement, including without limitation any representation or warranty contained in this Agreement; (ii) Your use of the site; or (iii) you give I-DATING or any of the Indemnified Parties of information or other data.
You agree to hold all parties of I-dating harmless by using this site.
21. GOVERNING LAW; JURISDICTION AND VENUE
The Website, Services, and this Agreement, including without limitation this Agreement’s interpretation, shall be treated as though this Agreement were executed and performed in Los Angeles, California and shall be governed by and construed in accordance with the laws of the State of California without regard to its conflict of law principles. ANY CAUSE OF ACTION BY YOU ARISING OUT OF OR RELATING TO THE WEBSITE, SERVICES, OR THIS AGREEMENT MUST BE INSTITUTED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE OR BE FOREVER WAIVED AND BARRED. ALL ACTIONS SHALL BE SUBJECT TO THE LIMITATIONS SET FORTH IN ABOVE. The language in this Agreement shall be interpreted in accordance with its fair meaning and not strictly for or against either party.
Requirement of Arbitration.
You will pay for all cost if we have to go to court for any reason. We will abide by all the laws of the state of Utah. The arbitrator shall award costs (including, without limitation, the JAMS’ fee and reasonable attorney’s fees) to the prevailing party.
22. TERMINATION
(a) By I-DATING
I-Dating has the right to deny use of the website or service to any person for any reason and for no reason at all.
(b) Automatic Termination Upon Breach By You
This Agreement shall automatically terminate if You breach any of this Agreement’s representations, warranties agreements. Such termination shall be automatic, and shall not require any action by I-DATING.
(d) Effect of Termination
Any termination of this Agreement automatically terminates all rights and licenses granted to You under this Agreement.
(e) Legal Action
If I-dating takes legal action against you because of any actual or suspected breach of this agreement, I-dating will be entitled to recover from you as part of such legal action. You agree to pay for these legal fees that are reasonable.
(f) TERMINATION
I-dating can terminate the site or members whenever it chooses too.
24. GENERAL
This agreement may be modified at anytime by I-Dating.
25. Affiliation
By using I-dating you understand and know that this site has not direct affiliation with BYU-Idaho. This site may be used by the students attending the school but is no way endorsed or monitored or working with the school.
